ARTICLE 1 - DEFINITIONS
The AMIS is a Web portal owned by the Ministry of Agriculture, hosted by Namboard and aiming to streamline Swazi farmers produce marketing.
"Namboard" is National Agriculture Marketing Board of Swaziland.
"AMIS" is Agricultural Marketing Information System of Swaziland.
"Subscriber" is any registered user on the AMIS.
"Stakeholders" is a public or private organization with special permissions and obligations at the AMIS.
"Farmer" is an Individual or Company which owns Plantings or does Produce Imports/Exports.
"Planting" is every agricultural plantation in Swaziland.
"Harvesting" is each planned individual harvest amount of a specific Planting. Every Planting can have many Harvestings.
"Retail Prices" are commodity customer selling prices per Kg in SZL (Emalangeni), collected by the Ministry of Agriculture in local markets.
"Producer Prices" are average prices estimated by Namboard.
"Imports" is the total quantity imported by Commodity in metric Ton.
"Exports" is the total quantity exported by Commodity in metric Ton.
"User" means everyone who accesses the AMIS Web portal.
ARTICLE 2 - FUNCTIONING OF THE SERVICE
All users can view the Blog and Forum posts and comments, the News section, and download files from the Library.
Subscribers can access a specific set of statistics and reports, and can post comments on Blogs and Forums and create Forum threads. They can also be alerted of events or relevant information by e-mail.
Namboard, as the service administrator, can access all available records and information but can't disclosure it. Namboard and the stakeholders will be in charge of content update and management. Every User is invited to contribute to the AMIS by providing articles for Blogs, opening Forum threads, make comments, send electronic files on the agricultural marketing subject (must use the account support@amis.co.sz) and to make suggestions for future system upgrades or to streamline the processes included.
Stakeholders can edit Planting and Farmer records on their behalf with due authorization
ARTICLE 3 - AMOUNT DUE - COSTS OF THE SERVICE
All information provided by the AMIS is free.
Subscription (registered user) has no cost but can be changed in the future. The Subscriber will be alerted in such event and will have the option to Cancel his subscription. Farmers have free access to AMIS.
ARTICLE 4 - LIMITATION OF RESPONSIBILITY OF NAMBOARD
The data provided on the AMIS is captured from the Farmers and Stakeholders in Swaziland based on estimations and not actual yields and prices. There isn't any guarantee that the information includes all the farmers and plantings in the country.
All information provided in the AMIS intends to help all agricultural stakeholders in their businesses. Namboard and all data providers shall not be liable for any losses or damages incurred by using the information provided.
Namboard does not guarantee the provisioning of the Services in cases due to circumstances beyond its control or for fortuitous case, as properly for example, political-social unrest or natural events.
The User acknowledges and accepts the fact that occasionally Namboard performs electronic operations of maintenance on own servers and equipments. In case Namboard was forced to interrupt the service to carry out such operations, it will use any efforts to contain the period of interruption and/or malfunctioning of the Services. The User also aware and accepts the fact that Software and applications provided from Namboard are subject to the ordinary defective state of every Software and its application, with exoneration of responsibility of Namboard for any direct or indirect damage or loss of data resulting from such cause.
The missing, delayed or defective distribution of the Services or for the loss or corruption of data resulting from the circumstances mentioned before, do not force Namboard to refund or to recognize to the User or to any third party any compensation for the eventual suffered damages.
ARTICLE 5 - Termination
Namboard has the right to terminate the Service at anytime, without obligation to indicate the reasons and/or to pay any penalty.
The User has right to terminate his subscription anytime without obligation to indicate the reasons and/or to pay some penalty.
ARTICLE 6 - OBLIGATION, PROHIBITION AND RESPONSIBILITY OF THE USER
The User undertakes to protect under maximum level of privacy and not to transfer or communicate to third party its own username and password and the User is the sole responsible for the safety of them. The User will be therefore responsible of the damages caused by the knowledge or the use of its username and password by any third party.
The User declares that the data of its own Profile as indicated at the time of Sign up and Activation are true and undertakes to maintain constantly updated such data, included own E-mail Address and the number of mobile phone.
The User undertakes not to use the services or to break the Law and/or to transmit any type of material that is against the Laws, the public order, the good custom, or rather threatening Messages, insulting or offensive content, that put themselves in violation of the rights of third party, that are blasphemic, that they incite to break the Laws or that they are actions to cause damages to third party.
The User obligates him/herself not to use the Services for the transmission or diffusion of pieces of material or material covered from copyright, except expressed written consent by the holder of the right.
The User obligates him/herself not to use the Services to:
- violate the security or to bring otherwise damage to the archives, devices for the transmission of data and computer;
- violate the confidentiality and privacy of other Users or any third party, reading or intercepting communications addressed to them;
The behaviors specified to the previous points can constitute crimes and so they may be punished according to law in force.
The User declares that the own data provided at the time of Sign up and Activation are true and refer to the same Customer. Namboard does not verify the authenticity and the correctness of the data provided by the User: no contractual or extra-contractual responsibility will apply to Namboard as a result of the uncorrectness of the same data. The User declares expressly that the Cell Number communicated belong to it and free Namboard from any responsibility and risk integrally, in the event that such declaration is not true.
The User accepts that, in case of controversy risen with reference to material transmitted through the use of the Services, Namboard will have the faculty to suspend the Services until when such controversy will be resolved, remaining explicitly excluded the Namboard obligation to perform any refund or compensation to the User for the missing use of Services from the User during the period of suspension.
ARTICLE 7 - COMMUNICATIONS - CLAIMS - REQUESTS OF TECHNICAL SUPPORT
Every communication according to this terms, and any claim with respect to the Services will have to be sent to Namboard through an email to the address: support@amis.co.sz. Every request of technical support will have to be forwarded also and exclusively by email to the e-mail address: support@amis.co.sz.
